Accessibility.  Access to any company’s website can be challenging for those having certain disabilities. A person’s access challenges are often unique. What may work well for one person, may cause difficulties for another person. We have made efforts to accommodate as many of our customers and potential customers as is reasonable given our size, resources, and knowledge of our customers, and potential customer’s needs.

Introduction: This policy describes the types of information FabricTech 2000, LLC d/b/a PureCare (“Purecare” "Company" or "We") may collect from you or that you may provide when you visit the website www.purecare.com (our "Website" or “Site”) and our practices for collecting, using, maintaining, protecting, processing, and disclosing that information. By accessing or using this Website, you acknowledge the terms of this Privacy Policy.

Not Intended for Customers Outside the United States

We are based in the United States, and the information we collect is governed by U.S. law. While you may view this Website, you can only purchase products through this Website if you are located in the United States. Please do not register for our newsletters or advertisements if you are not located in the United States.

Regardless of where you are located, we only collect and process your personal information where we have a lawful basis to do so.  This may include, depending on the information and its use, to fulfill a transaction (when you purchase our products), or perform your contract (warranty) with us.  If you give your consent to us (for example, to receive newsletters or to participate in a survey), we will only use the data collected for the purpose to which you consented.

By accessing or using the Website, or otherwise providing information to us, you are acknowledging the terms of this Privacy Policy.

Not Intended for Children:

This Site is not intended for use by children. By using this Site, you are representing to us, intended for us to rely on that promise, that you are at least 18 years of age or older.

Site User Content: Please be aware that generally any information including, without limitation, user content that you post to the Site may be accessible by other users of the Site. Please be sure that any such information is information that you are comfortable sharing with the public.

Correction of Information; Requests to Erase: If you are asking about information as to yourself, to correct your information, or to tell us to forget you (or “erase you”) (see information below.

While we are not subject to many of the privacy laws recently adopted by various states, we endeavor to afford our customers rights also afforded to those located (for example) in California, consistent with the California Consumer Privacy Act, as amended by the California Privacy Rights Act.

Please note that we will ask you to verify you are who you say you are before we process the request. We will also collect your contact information to respond to the request. We keep a record of these requests, who made the request, how and when we responded, and what information we provided.

Some States have special categories of information, which may be referred to as “sensitive” information or “protected health information”. We do not collect any “sensitive” information (e.g. as to your religion, health, etc.).  Our third party payment processes comply with the Payment Card Processors’ Data Security Standards, and we require them contractually to comply with your exercise of your rights.

Passwords for Any Users Who Create an Account: If you register to create an account on this Site, you have the ability to create a password. To best protect yourself, use unique passwords for unique accounts (do not use the same password for your PureCare account as you do (e.g.) for your bank account or email account). Do not share your password with someone else. If you think your password or account was compromised let us know at customerprivacy@purecare.com.

You do not need to create a password or to create an account with us to complete a transaction with us.

If you purchase our products a third party retailer (online or a brick and mortar location) and purchase a warranty for our products, we will receive that information so we can full fill our warranty obligations.  This information will include your name, your address (for warranty service), the product you purchased, and the date of purchase

We do not collect from our customers and site visitors any:

  • Insurance information
  • Protected classification characteristics (such as age, medical condition, sex, sexual          orientation, religion, immigration status, union affiliation or other such data.

Note that Personal Information does not include:

  • Publicly available information from government records;
  • de-identified or aggregated consumer information; or
  • de-identified data website and mobile app activity and history, not attributable to an identified or identifiable consumer (“Usage Data”).

Third Party Service Providers and Your Purchasing/Return Activities:

We do not collect or store your credit card number, your gift card information or your debit card (or other payment method). We use third party providers to do this for us. At present, we use Worldpay to process payments for us. If you use a particular source of funds (for example your Amazon or PayPal account), those sites and applications will collect your transaction information. These are accounts you created, and you should review the terms of use and privacy policies of those providers that you choose.

When you: proceed to check out, or ask us to credit a return, your transaction information, including your name, password, email or other points of contact, and payment information is stored by our third party provider(s). You can check out as a “guest” without creating an account and setting a password. Our service providers that process payments have certified that they are PCI (payment card industry) compliant, and they have contractually committed to maintain your information in accordance with applicable laws.  If you set up an account with a third party payment processor (e.g. PayPal) your data protection and your privacy rights are governed by that third party processor’s privacy policy.

These third party providers are not authorized by us to use the information you provide for your purchases, credits, returns, and account information except to help us do our business with you, or as required by law (for example, to confirm there is no fraudulent transaction). These providers have also committed to cooperate with us when you exercise certain choices (for example, of you want to be forgotten).

EXCEPT AS STATED IN THIS PRIVACY POLICY, WE DO NOT OTHERWISE DISCLOSE, SELL, OR SHARE PERSONAL INFORMATION WITHOUT NOTICE OR CONSENT, AS REQUIRED BY APPLICABLE LAW.

We may make the following such disclosures under written contracts that describe the purposes, require the recipient to keep the Personal Information confidential, and prohibit using the disclosed information for any purpose except performing the contract for us.

Cookies, Beacons and other Automatic Data Collection Technologies; Do Not Track Signals

Some web browsers may transmit "do not track" signals to the websites and other online services with which the browser communicates. There is no standard that governs what, if anything, websites and online services should do when they receive these signals. We currently do not take action in response to these signals. If and when a standard for responding is established, we may revisit our policy accordingly.

Note that we do not sell your data, nor otherwise permit third parties to use your data, for purposes of such parties’ marketing purposes.

How we use information collected by Automated Technology:

To improve our Website and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns

  • Help you navigate through the Site;

  • Store information about your preferences; and

  • Recognize you when you return to our Website.

Types of Automated Technology and Your Options:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website.

  • Web Beacons. Pages of our Website, our e-mails, and Services may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).

  • Google Analytics: We may use a tool called “Google Analytics” to collect information about use of the Site. Google Analytics collects information such as how often users visit our Site, what pages they visit when they do so, and what other sites they used prior to coming to our Website. We use the information we get from Google Analytics only to improve our Site. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit our Site. We use information that we collect about you or that you provide to us, including any personal information:

  • To send you advertisements and newsletters when you opt-in to receive them;

Gifts: If you are purchasing a gift for someone, and you give us that person’s information for shipping, we are relying on you to make sure you have the right (and consent if needed) to provide to us the recipient’s information.

How Long We Keep Your Information:

We retain your information for only as long as we need it for the purposes described in this Privacy Policy, for our own administration and internal business purposes, and for any periods that are mandated by law, after which we take steps to delete or anonymize your information.

Aggregated, Anonymous Information: We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. This information either never included you by your personal information, or your personally identifying information has been stripped (anonymized).

Third Parties to Which We Disclose Your Information: We may disclose personal information that we collect or that you provide as described in this privacy policy:

  • To our subsidiaries and affiliates;

  • To service providers we use to support our business as described in this Policy (for example, to process payments, to detect fraud, or to service products you have purchased from us);

  • Onward Transfers: To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company about our Website users or customers is among the assets transferred;

Your Privacy Rights

Under applicable laws, including, but not limited to, the California Privacy Policy Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020; the Colorado Privacy Act; the New Jersey Consumer Privacy Law; the Texas Data Privacy and Security Act; and the Virginia Consumer Data Protection Act, and their implementing regulations, you may have certain rights in connection with your Personal Information.

This Privacy Policy explains what information we collect, how we use it, where we get this information, and with whom we share it. We also provide in this Privacy Policy information about our security practices, how you can contact us if you have a dispute, and how to correct your information.

We do not collect: any state or government issued identifiers (such as social security numbers, passport numbers, drivers’ license numbers), employment or employment related information, health information, sex or sexual orientation, veteran’s status, religion, political affiliations, biometric data, geolocation data, sensory information, education history or other “sensitive” information.

No Inferences Drawn: We do not profile you based on the information we collect as to any psychological trends, intelligence, aptitudes or behavior.

We Also Use Personal Information To:

  • Process your request to be forgotten
  • Verify who you are before we will process these requests

In the Last Twelve (12) Months, We Have Not Sold Your Personal Information. If we ever do consider selling personal information, we will first provide to you notice, and afford to you an opportunity to opt out.

Your Rights and Choices

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you;
  • The categories of sources for the personal information we collected about you;
  • Our business or commercial purpose for collecting that personal information;
  • The categories of third parties with whom we share that personal information;
  • The specific pieces of personal information we collected about you (also called a data portability request); and
  • If we disclosed your personal information for a business purpose, the disclosures we made, the purpose for the disclosure, and identifying the personal information categories that each category of recipient obtained.

Deletion (the right to be forgotten) Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you. See below regarding impact on warranties;
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  3. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
  4. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  5. Comply with a legal obligation; and/or
  6. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

How a Deletion Request Will Affect Your Warranty

A REQUEST TO DELETE ALL YOUR PERSONAL INFORMATION VOIDS ALL PURECARE WARRANTIES.

BY EMAILING CUSTOMERPRIVACY@PURECARE.COM AND REQUESTING TO DELETE ALL PERSONAL INFORMATION YOU HEREBY ACKNOWLEDGE THAT YOUR REQUEST TO DELETE ALL PERSONAL INFORMATION AND/OR THE INFORMATION NECESSARY FOR US TO VERIFY PRODUCTS AND/OR WARRANTIES YOU PURCHASED OR WHICH WERE PURCHASED ON YOUR BEHALF, WILL NULL AND VOID ANY AND ALL WARRANTIES PURCHASED BY OR ON YOUR BEHALF FOR ALL PRODUCTS OR MATTRESSES PURCHASED FROM AND/OR PROVIDED BY PURECARE.

THIS IS A NECESSARY CONSEQUENCE OF PURECARE HONORING YOUR DELETION REQUEST, AS BY DELETING ALL OF YOUR PERSONAL INFORMATION PERTINENT TO YOUR WARRANTY AND PRODUCT PURCHASES, PURECARE CANNOT THEN VERIFY THE PRODUCT AND/OR WARRANTY THAT WAS PURCHASED BY OR ON YOUR BEHALF FROM OR PROVIDED BY PURECARE, AND THUS PURECARE WILL BE UNABLE TO PROCESS ANY AND FULFILL ANY OF YOUR WARRANTIES.

FOR MORE INFORMATION, PLEASE REFER TO YOUR WARRANTY BEFORE YOU CHOOSE TO PROCEED WITH YOUR REQUEST FOR US TO DELETE ALL OF YOUR INFORMATION.

NOTE: YOU CAN EXERCISE YOUR RIGHT TO UNSUBSCRIBE FROM RECEIVING ANY MARKETING MATERIALS FROM PURECARE WITHOUT VOIDING YOUR WARRANTY.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Or writing to us at Purecare, 1402 S. 40th Ave Phoenix, AZ 85009.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child (anyone under the age of 18 in California).  Remember, this site is not intended for minors.

Please note that you may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

  • Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Only you, or someone legally authorized to act on your behalf (an authorized agent), may make a request related to your Personal Information. If you authorize an agent to make verified requests on your behalf, we may require either:

  • the authorized agent to provide proof that you gave the agent signed permission to submit the request;
  • that you directly verify their own identity with us; or
  • that you confirm that you provided the authorized agent permission to submit the request.

Denial of Right

To the extent permitted by law, we may deny your request (even in part) if necessary for us, service provider(s), or contractor(s) to perform the following:

  • to complete the transaction for which the Personal Information was collected;

  • to fulfill the terms of a written warranty or product recall conducted in accordance with federal law;

  • to provide a good or service requested by a consumer, or reasonably anticipated by the consumer within the context of a business’ ongoing business relationship with the consumer;

  • to otherwise perform a contract between a consumer and us; 

  • to help to ensure security and integrity to the extent the use of a consumer’s Personal Information is reasonably necessary and proportionate for those purposes;
     
  • to debug to identify and repair errors that impair existing intended functionality;

  • to exercise free speech, ensure the right of another consumer to exercise that consumer’s right of free speech, or exercise another right provided for by law;

  • to engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the ability to complete such research, if a consumer has provided informed consent;

  • to enable solely internal uses that are reasonably aligned with the expectations of the consumer based on a consumer’s relationship with us and compatible with the context in which the consumer provided the information;

Appeals Process

If you are unsatisfied with our decision to not comply with your request, you may submit an appeal.  We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions, not later than forty-five (45) days after receipt of an appeal. If your appeal is denied, you may contact your local state Attorney General to submit a complaint.

Response Timing and Format (meaning how we deliver the response)

We endeavor to respond to a verifiable consumer request within the time frame mandated by your state of resident’s law, or otherwise within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the twelve (12) month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.

  • If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your rights. Unless permitted by law, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Other California Privacy Rights

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Choices and Opting In or Out:

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information.

Our online advertising and newsletters: When you make a purchase with us, you will see at the point of checkout an option to “opt out” of receiving information in the future about the product you are purchasing, other products, and our newsletters. Unless you have purchased our products, we will not send you emails or newsletters about our products unless you opt in (meaning you consent and choose to “opt in” to receive those advertisements). Also, at the point of purchase, you can opt-out of receiving any advertising or newsletters. Every advertisement we send to you will allow you at any time to “opt out” of receiving any more advertisements from us. You can also opt out by emailing opt-out@purecare.com and we will process your request.

You may choose to opt out of receiving communications, such as phone calls, e-mails or mailings from Purecare, and/or the distribution of any personally-identifiable information, such as your name and email address from Purecare to Women’s Choice Award, and/or if you wish to have us delete or destroy any names, email addresses, phone numbers, content or communications you send to us or the like, you may use the opt out mechanism that is provided here: opt-out@purecare.com or send by certified mail, a written opt out election to the attention of our Marketing Director at: Purecare, 1402 S. 40th Ave Phoenix, AZ 85009.

If a Site user makes this election, all of the Site user’s personally identifiable information will be removed from Purecare’s servers permanently. 

Note that you can also selectively ask to be forgotten, asking us to retain information necessary for your warranty.

Continued Communication After you Opt-Out: We may still send you correspondence (about, for example, a purchase you made, or to verify who you are before we honor a request to “forget you”), to enforce our rights, and to alert you of any suspected or actual fraud or problem, whether with your payment, our Site or otherwise.
